Terms of Use
Last updated: November 5, 2026
These terms apply to your use of the Asphalt Eye app. The app is developed and provided by Ayberk Altuntop. In this text, "we" refers to us.
Because you downloaded the app from the App Store, Apple's standard license agreement also applies (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). These terms are in addition to it. If the two differ, the one that's more favorable to you applies.
You accept these terms by tapping "Let's Start" on the app's first screen. If you don't accept them, don't use the app.
What the App Does
The app turns your iPhone into a dashcam. It records the road, keeps track of your route and speed, and marks events such as hard braking and impacts. It helps you record the condition of a rental car with photos at pickup and return, and prepare a report and package after an incident.
Recordings contain information that can be used as evidence in an accident or dispute. But we don't decide how an authority, insurance company or court will assess a recording. The app doesn't guarantee any outcome.
Recording May Not Always Be Possible
The app can't guarantee that a moment will be recorded. For example, recording may fail or be incomplete when:
- Camera, location or another permission hasn't been granted.
- The phone has overheated, its battery is low or its storage is full.
- The vehicle hasn't moved for a long time. If the recording screen is open, we ask first whether to keep recording.
- You've left the app and Background Recording (Premium) isn't on. In that case, video stops and route recording continues.
- iPhone has stopped the camera. For example, when the small window is hidden while the app is in the background, when the phone is locked, or when another app is using the camera.
- The app has been closed or the phone has restarted.
- With loop recording on, the oldest unlocked recordings are deleted when the storage limit is reached. With Short Loop on, unlocked footage is kept for 2 minutes at most.
To keep an important moment, lock the clip. Clips you lock aren't deleted by loop recording. With Short Loop on, clips locked automatically on hard braking, and clips of an impact you mark as "Not an Accident," are deleted after 3 days unless you keep them.
Driving Safety
- Don't hold your phone, touch the screen or look at it while driving. Start recording before you set off. Check the results when you've stopped.
- To keep a moment while driving, say "Lock clip with Asphalt Eye" to Siri. On an impact, the clip is locked automatically.
- Watch recorded videos while the vehicle is stopped.
- Mount the phone where it won't block your view or interfere with driving. The phone shouldn't keep you from seeing the road, traffic or signs. Follow local rules on where a device may be mounted. In some places, a phone may be mounted only in a lower corner of the windshield or on the dashboard.
- Always follow traffic laws. The app's alerts and information don't replace careful driving.
Emergencies
The app isn't an emergency service. It doesn't call anyone on its own. It doesn't report an impact to other people or to any authority. It may not detect every collision. Impacts are detected only while a trip is being recorded and the phone is steady in a mount.
If anyone is hurt or you need help, call the local emergency number yourself. In some countries, the Incident Screen shows an emergency number. The country is found from the incident location. If the location is wrong or you're near a border, the number shown may not be the one for the country you're in. When you tap the call button, iPhone asks before calling.
The list on the Incident Screen is a general reminder. It isn't legal advice. Your legal duties at the scene of an accident, such as stopping, helping anyone who's hurt and reporting the accident to the authorities, don't depend on the app.
Lawful Use of Recordings
- Other people, vehicles and license plates may appear in recordings. If audio recording is on, conversations are recorded. If the cabin camera is on, images of the people in the vehicle are recorded. You're responsible for using and sharing recordings lawfully.
- Tell the people in the vehicle and get their permission before turning on audio recording or the cabin camera. Tell anyone new who gets in too.
- Recording audio without permission may be a crime in Türkiye and in many other countries. Conversations recorded without permission may not be accepted as evidence. Several US states (for example California, Florida, Illinois, Maryland, Massachusetts, Pennsylvania and Washington) and several Australian states require the permission of everyone taking part in a conversation. Some Australian states also prohibit filming the people in a vehicle without their permission.
- In some places, a vehicle with a camera must display a visible notice that it records or that conversations may be recorded.
- Don't record other people's conversations when you're not in the vehicle. Turn off audio recording or stop recording when you get out.
- You can give recordings to the police, a prosecutor, a court, your insurer or your lawyer.
- Before publishing recordings online or on social media, make faces and license plates unrecognizable. Don't publish conversations, footage from inside the vehicle, injured people or footage showing people's private lives without their permission. In Türkiye, sharing footage on social media that encourages or praises breaking traffic rules is also prohibited.
- Record and share witness details and document photos only with the person's permission.
- If you use the app in a taxi, a shuttle, for carrying passengers, in a company vehicle or for other work, data protection laws give you more duties. Tell passengers and employees before recording.
- In some countries, using a dashcam or sharing recordings is restricted or prohibited. Check the local rules before using the app in another country. You're responsible for following the rules of the country where you record.
- In many European countries, for example Germany, Austria, Switzerland and Luxembourg, the road may be recorded only in short loops, and footage may be kept only after an incident. In these countries, turn on Short Loop in Settings. Even with Short Loop on, recordings may not be accepted as evidence in some countries.
- Don't use the app to secretly monitor or harass others or for any unlawful purpose.
Measurements Are Approximate
- Speed is measured from your phone's location (GPS). It may differ from your vehicle's speedometer and from radar readings. When the signal is weak, it may not be measured or may be shown as approximate.
- Events (hard braking, rapid acceleration, hard cornering, impact), Driving Score, elevation, and the start and end of auto trips are calculated from your phone's sensors. They may be wrong or incomplete.
- The date and time in videos and reports come from your phone's clock. The app tries to verify the time and states the result in reports. It doesn't guarantee that the time is correct.
- Driving Score is calculated only from hard braking, rapid acceleration and hard cornering. The score doesn't show whether you follow speed limits or other traffic laws. It isn't an insurance, licensing or legal assessment.
Storing Recordings
- Your recordings are stored on your phone. Videos, trips, photos and packages aren't included in your iPhone backup.
- Recording Vault (Premium) isn't offered in Türkiye. Outside Türkiye, if you turn on Recording Vault, locked clips, trips, events, rentals and photos are also backed up to your own iCloud account. Unlocked loop recordings and evidence packages aren't included in the vault.
- A recording is uploaded to the vault only when there's an internet connection and enough iCloud storage. Recordings that haven't been uploaded yet can be lost with the phone.
- If Premium ends, recordings in the vault stay in your iCloud account, and new recordings aren't uploaded. You don't need Premium to restore from the vault.
- If you delete the app, or your phone is lost or damaged, the recordings on your phone are lost too. Recordings that aren't in Recording Vault can't be recovered.
- It's your responsibility to save recordings you want to keep to Photos or another safe place.
Rental Mode and Reports
Rental Mode helps you record the condition of a car with photos when you pick it up and return it. Reports can be used in a dispute with the rental company. But they don't guarantee an outcome. They don't replace your rental agreement or the company's handover form.
- A report shows only the spots you photographed. Damage that isn't visible in the photos or that's found later may not be in the report.
- You enter the odometer, fuel and damage notes yourself. You're responsible for entering them correctly.
- Have any damage you see written on the company's handover form too. If you email the report to the company at pickup, it's easy to show that it existed on that date.
Paid Features
There's no charge for recording, event detection, the Incident Screen, evidence packages and the rental photo walkaround. Some features (Premium) are paid. The Premium page in the app shows which features are Premium. You can get Premium in three ways:
- Premium Yearly: A subscription that continues until you cancel it. It's charged once a year, at the start of each period.
- Premium Lifetime: A one-time payment. It isn't a subscription and doesn't renew.
- Travel Pass: Unlocks Premium for 30 days. It doesn't renew automatically.
New Premium Yearly subscribers may be offered a 7-day introductory period. You aren't charged for these 7 days. Whether it's offered depends on the country. If it is, the purchase screen shows it. The subscription starts that day. If you don't cancel at least 24 hours before the 7 days end, the yearly price is charged. The introductory period is offered once per Apple Account.
If notifications are on, the app reminds you 2 days before the introductory period ends and 30 days before Premium Yearly renews each year.
Buying and Payment
Purchases are made on the App Store. Apple handles the sale and payment. In the European Union, the United Kingdom, Türkiye and many other countries, Apple Distribution International Ltd. (Hollyhill Industrial Estate, Hollyhill, Cork, Ireland) sells purchases in its own name on our behalf. Before you buy, the App Store shows the price, the length and whether it renews. Payment is charged to your Apple Account.
Canceling, Withdrawal and Refunds
- You can cancel Premium Yearly at any time from the Premium card in Settings or from Subscriptions in your Apple Account settings on iPhone. After you cancel, Premium stays on until the end of the period you paid for. To avoid being charged for the next period, cancel at least 24 hours before the current period ends.
- If the price of Premium Yearly goes up, Apple tells you in advance. If you don't accept the new price, you can cancel before it applies.
- Withdrawal and refunds are handled by Apple under Apple's terms and the law of the country where you live. You can ask Apple for a refund at reportaproblem.apple.com.
- If you live in the European Union or the United Kingdom, you can withdraw from a purchase within 14 days under Apple's terms.
- If you live in Türkiye, you can end your subscription right away and ask Apple to refund the unused part. Under Turkish law, there's no right of withdrawal for digital content delivered right away or for services performed right away online. Premium turns on as soon as you buy it, so this rule applies.
When Premium Ends
Nothing you recorded is deleted. Only Premium features turn off.
You can still share the report of these rentals after Premium ends:
- Rentals whose pickup walkaround you completed before your paid Premium (Premium Yearly, Premium Lifetime or Travel Pass) ended. This also applies if you did the walkaround before you bought it.
- Rentals whose pickup walkaround you completed during the introductory period of Premium Yearly.
This applies even if Premium is refunded.
Premium Lifetime
- Premium Lifetime unlocks Premium on your Apple Account with no end date. Features added to Premium later are included. Features sold as a separate product aren't included.
- Premium doesn't depend on our servers. If we remove the app from the App Store or stop developing it, Premium stays on in the app installed on your phone.
- We provide the updates needed for the app to keep working as described for as long as the law requires. After that, we can't promise that the app will work on every future iOS version or that you can download it again from the App Store.
Changes to Premium
We'll remove a Premium feature only if the Apple service it relies on ends, if Apple's rules or the law require it, or if a security problem makes it necessary. If a change significantly reduces what Premium Yearly offers, we'll tell you in the app in advance. You can then cancel and ask Apple for a refund of the unused part.
Limitation of Liability
We provide the app with reasonable care and skill, with the features described in these terms and on the App Store page. These terms explain the limits of what the app can do (see "Recording May Not Always Be Possible", "Measurements Are Approximate" and "Storing Recordings").
We aren't responsible for loss or damage that isn't caused by our fault. For example, loss or damage caused by:
- iPhone, iOS or Apple's services (Maps, Weather, iCloud) not working or giving wrong information.
- Your phone being lost or damaged, or the app being deleted.
- How you or others use recordings and who they're shared with.
- Not following traffic laws, other laws or these terms.
This section doesn't remove or limit our liability where the law doesn't allow it. Our liability for loss or damage caused by our intent, gross negligence or fraud, and for death or personal injury, isn't limited.
These terms don't take away the rights the law of the country where you live gives you as a consumer. For example:
- In Türkiye, your legal rights for faulty goods and services aren't affected.
- In the European Union or the United Kingdom, you have legal rights if the app or Premium isn't as described or doesn't work as it should.
- In Australia, our services come with guarantees that can't be excluded under the Australian Consumer Law. These terms don't limit those guarantees.
- In Quebec, these terms don't exclude our liability for our own acts.
Apple, as the seller, handles refunds. If the app doesn't work as described, please write to us too.
Weather information comes from Apple Weather. We don't guarantee its accuracy.
Changes
We change these terms only if the law or Apple's rules change, if a feature is added to or removed from the app, or to make the text clearer. If we change them, we'll publish the new version in the app and on our website and update the date at the top. Earlier versions also stay on our website.
If a change affects your rights, we'll show it in the app and ask for your approval. If you don't approve it, you can stop using the app.
Changes to these terms don't apply against you for a subscription period you've paid for, for Premium Lifetime or for a Travel Pass that's running. For changes to Premium features, the "Changes to Premium" section applies.
Governing Law and Disputes
If you're a consumer and you live in Türkiye, Turkish law applies to these terms:
- For disputes below the amount the Ministry of Trade sets each year, you apply to the consumer arbitration committee (tüketici hakem heyeti). You can apply to the committee where you live through e-Devlet.
- For disputes above that amount, you need to go to mediation before you file a lawsuit. If you don't reach an agreement, you can file the lawsuit at the consumer court where you live.
If you're a consumer and you live in the European Union, the United Kingdom, Switzerland, Norway or Iceland, the law of the country where you live applies to these terms. You can bring a claim in the courts where you live. You can also bring a claim in Türkiye.
If you live in another country, Turkish law applies to these terms. The rights that the law of your country gives you as a consumer and that can't be removed by a contract still apply. Where the law allows it, you can also bring a claim in the courts where you live.
If there's a problem, we recommend writing to us first.
These terms are available in Turkish and English. Both versions have the same content. If they differ, the meaning that's more favorable to you applies.
